ARTICLE 1: PURPOSE
These general conditions of sale govern the contractual relationship between PETIT CHELEM and its customers. Any order validated by the consumer implies the latter's unreserved acceptance of these general conditions of sale. These conditions may be modified by PETIT CHELEM. In this case, the applicable conditions will be those in force on the site at the time of validation of the order by the consumer.
These general conditions will apply from 1 October 2023.
ARTICLE 2: CONTRACTUAL INFORMATION
In accordance with the provisions of the French Consumer Code, the online shop set up by PETIT CHELEM as part of its website includes the following information:
- A legal notice allowing precise identification of PETIT CHELEM;
- A presentation of the essential characteristics of the goods offered;
- An indication in euros of the price of the goods and services and the delivery charges;
- An indication of the costs of payment, delivery or performance;
- The validity of the offer and its price;
- The existence of a right of withdrawal.
All the information on the petitchelem.com website is initially presented in French.
ARTICLE 3: PRODUCTS
a. Prices
The prices of our products on the site are given in euros, inclusive of all charges but excluding delivery costs. They are applicable when the order is validated by the consumer (subject to availability).
It should be noted that if items have an inconsistent price on the PETIT CHELEM website (e.g. a bag at 1 euro, a reel of ropes at 4 euros...), PETIT CHELEM will be able to refuse to deliver to the customer and this order will be cancelled or returned to PETIT CHELEM by the customer if it had been delivered by mistake.
Depending on the value of the order and the shipping destination, shipping costs may be added to the order total (see Shipping below).
Prices are subject to French VAT and any change in the legal rate of this VAT will be implicitly passed on to the prices of the products presented on the Petitchelem.fr website on the date stipulated by the relevant implementing decree.
Items will be dispatched free of tax if they are sent to a country outside the European Union or to French overseas departments and territories. However, customers will be obliged to declare these items on receipt.
The public prices displayed generally correspond to the sales prices recommended by the manufacturers.
b. Availability
The offers presented by PETIT CHELEM are only valid while stocks last. In the event of unavailability and in accordance with article L 121-20-3 of the French Consumer Code, you will be informed by e-mail or telephone of the items that are out of stock.
The purchaser will then have 72 working hours (excluding Saturdays, Sundays, public holidays or non-working days) from the date of purchase to request cancellation, reimbursement of the sums paid or exchange of the order within the limit of an equivalent total price by contacting us by e-mail at contact@petitchelem.fr.
After this period and if no request is made on your part, your order will be sent to you with the available items and only these items will be invoiced to you. Unavailable items will be refunded by the same method of payment used by the customer to pay for the order.
The customer has the possibility of reserving goods on order from our suppliers. If the order is incomplete, PETIT CHELEM reserves the right to dispatch the goods when all the items in the order are in stock. The customer can ask PETIT CHELEM for immediate delivery of the incomplete order in return for the cost of postage for the second shipment.
c. Conformity of product offers
The products offered comply with current French legislation and the standards applicable in France. In accordance with article L 111-1 of the French Consumer Code, the consumer has the possibility of knowing the essential characteristics of the products he/she wishes to purchase before placing a final order. Professional players are likely to play with different racquets than those shown.
d. Discount codes and gift vouchers
Discount codes :
Simply insert the code in the ‘Promo Code’ bar on the order page of your basket, and the discount will be applied immediately. Please note that discount codes are not cumulative and always have a validity period.
Gift vouchers:
If you order a gift voucher on our site, we will send you the gift voucher by email, indicating on the voucher the discount code that the recipient can use to spend the credit received. You will receive the cheque by email in pdf format, so you can print it out and give it in person to the person of your choice.
ARTICLE 4: THE ORDER
a. Placing the order
These general terms and conditions of sale come into force on the date of signature of the order form on our petitchelem.fr website. In accordance with the LEN law of 21 June 2004, you have the opportunity to check the details of the order and its total price (price in euros including all charges and products plus delivery costs) and to correct any errors before confirming it to express your acceptance. However, the order can only be modified once it has been prepared in our warehouses, for goods made and personalised according to the consumer's specifications (ropes, flocking, grip modification...).
PETIT CHELEM will acknowledge receipt of your order electronically without delay.
b. Transfer of ownership
PETIT CHELEM retains full and complete ownership of the products sold until full collection of all sums due by the consumer in connection with his order, including costs and taxes. The transfer of ownership of goods purchased on petitchelem.fr by the consumer to a third party will not be undertaken by PETIT CHELEM. Only the original purchaser of the goods may claim access to the clauses of these general conditions of sale.
c. Proof of transaction
Purchase orders and invoices will be archived on a reliable and durable medium that can be legally produced as proof.
ARTICLE 5: WITHDRAWAL AND GUARANTEES
You have the right to withdraw from this contract without giving any reason within thirty (30) days. More information on returns and refunds on this page:

Legal guarantee of conformity
The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was his responsibility under the contract or was carried out under his responsibility.
To be in conformity with the contract, the goods must :
- Be fit for the use normally expected of similar goods and, where applicable :
- correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- Have the qualities that a buyer may legitimately expect in view of the public statements made by the seller or the manufacturer.
A two-year legal guarantee of conformity applies to your purchases, particularly tennis rackets. If a tennis racket is defective other than through normal use, the customer may return it to Petit Chelem. It will be carefully analysed by us to determine whether or not there is a defect and will then be returned to the supplier.
According to articles 211-1 to 211-4 of the Consumer Code: Before 18 March 2016, the presumption of anteriority is 6 months from delivery for all goods. The consumer is exempt from providing proof. For goods purchased after 18 March 2016, all lacks of conformity appearing during the 2 years following the purchase, with the exception of second-hand goods for which the period will be maintained at 6 months, are presumed to exist. Consumers will not have to provide any additional proof, as it is up to the professional to prove that the defect did not exist. You will then be contacted as soon as possible by Petit Chelem's after-sales service.
If the claim is accepted, the customer may, depending on the product, obtain an exchange or repair from Petit Chelem. If the repair or replacement of the product cannot be carried out or is not desired by the customer, a voucher for an amount equivalent to the purchase price of the item will be offered.
Credit notes issued as part of a customer return/cancellation are only valid for one year and will be automatically cleared after this period.
RETURNS AND REFUNDS
RETURN CONDITIONS :
For a refund, exchange or credit note to be accepted, the product must be new, complete and in its original packaging.
The refund, exchange or credit note may be refused if the product is not in new condition or if it is incomplete when it is received in our warehouse.
Petit Chelem undertakes to provide the refund, exchange or credit note concerned within 72 hours (3 days) maximum, provided that the product(s) returned comply with the return conditions.
Whatever the outcome of a request for a refund, exchange or credit note, the customer will be notified by e-mail within a maximum of 72 hours of receipt of the parcel in our warehouse.

RETURN COSTS :
The cost of returning goods is borne by the customer. Returns are accepted and may give rise to an exchange or credit note or refund only if made within a maximum of 30 days of receipt of the order.
If the product received by the customer is defective or does not conform to the initial order, Petit Chelem undertakes to reimburse or replace the product concerned free of charge at its own expense, subject to proper receipt of the product concerned.
REIMBURSEMENTS :
We remind you that the maximum period for returning one or more products is thirty (30) days from the date of receipt of the parcel by the customer.
Refunds are made using the same method of payment that the customer chose at the time of purchase.
As a reminder, a refund, exchange or credit note will only be issued if the return conditions are respected.
ARTICLE 6: DELIVERY
a. Delivery :
PETIT CHELEM delivers its products in mainland France (including Corsica). The products will be delivered to the address indicated by the consumer on the order form.
Shipments to France :
For deliveries to relay points in mainland France, Petit Chelem uses the Relais Colis carrier. A flat-rate contribution of €4.90 towards shipping costs is required for all orders of €49 or less.
For home deliveries in Metropolitan France, Petit Chelem uses the carrier COLISSIMO. A flat-rate contribution of 7.90€ towards shipping costs is required for all orders up to 69€.
Petit Chelem uses Chronopost for express deliveries to relay points in mainland France. A flat-rate contribution of €12.90 towards shipping costs is required for all orders, regardless of the value.

For heavy items (nets, court accessories, reservation boards, boxes and barrels of balls, fitness equipment, etc.), a variable supplement will be charged depending on the country of delivery without carriage paid (see table below). The consumer has a legal and contractual obligation to check the physical condition and contents of the parcel(s) on delivery in the presence of the delivery person.
Shipments to Belgium, Luxembourg, Germany, Italy, Spain and the Netherlands :
For deliveries to Germany, Italy, Belgium, the Netherlands, Luxembourg, Spain and Portugal, we only offer delivery to relay points. Delivery charges vary according to the country of dispatch. These charges are indicated below:

b. Anomaly
Any anomaly concerning the delivery must be indicated on the carrier's delivery slip in the form of detailed handwritten reservations, dated, explicit and accompanied by the signature of the consumer or a person authorised to receive the delivery.
At the same time, the consumer must report this anomaly by sending the carrier a registered letter with acknowledgement of receipt setting out the aforementioned complaints within 3 working days of the delivery date.
They must then simultaneously send a copy of this letter by post to :

Any complaint concerning the delivery received after the deadline will be definitively rejected without any possibility of recourse for the consumer and only the damage and anomalies mentioned in the aforementioned reservations issued by the consumer will be taken into account in the resolution of the dispute by the carrier.
c. Delay or non-performance
Delay in delivery or failure to execute the order PETIT CHELEM cannot be held responsible for failure to execute the contract in the event of stock shortage or unavailability of the product, force majeure, disruption, total or partial strike, particularly of the postal services and means of transport and/or communication, flood or fire.
PETIT CHELEM cannot be held responsible for any indirect damage due to operating losses, loss of profit, loss of opportunity, damage or costs that may arise from the purchase of products.
ARTICLE 7: PAYMENT
Payment must be made in full when the order is placed. At no time may the sums collected be considered as deposits or advance payments. The consumer guarantees PETIT CHELEM that he/she has the necessary authorisations to use the method of payment that he/she chooses when validating the order. Furthermore, PETIT CHELEM reserves the right to suspend any order or delivery in the event of refusal of authorisation by financial organisations.
a. Payment methods
To pay for their order, the consumer has a choice of different methods of payment offered at the time of final validation of the order form. PETIT CHELEM reserves the right to ask the customer for a scan of their identity card, proof of address and any other document required as part of its anti-fraud policy.
Payment by credit card
The processing of credit card orders on our site is entirely secure. By this means of payment, you will be debited when you pay for your order.
PETIT CHELEM uses the Stripe banking platform. Your data is therefore encrypted using the SSL process, guaranteeing maximum security. Your bank card number is neither stored on the server nor printed.
The order thus validated by the customer on the website will only be effective once the central credit card network has given its approval. In the event of refusal, PETIT CHELEM reserves the right to cancel the order and to stop the dispatch of the parcel. In this case, the customer will be contacted by e-mail or telephone as soon as possible.
Secure payment by PayPal
If you have an account on the PayPal online payment platform, you can also use this system to pay for your purchases on our site. This online method is easy to use and allows rapid processing. The identity of the PayPal account is defined by the customer's e-mail address. A payment made via this platform will be credited immediately, as opposed to a bank transfer, which takes longer to verify.
Payment in instalments
On PETIT CHELEM, the consumer has the possibility of paying for his order in several instalments with Alma. Alma is a credit card payment organisation. The consumer must enter their bank details in the same way as a traditional payment, then Alma will indicate the amount and dates of future instalments according to the number of instalments chosen: 2, 3 or 4.
Once the first instalment has been paid, the order will be validated and the consumer will receive a confirmation e-mail without delay.
In accordance with the due dates indicated before the first payment is made, Alma will proceed with automatic debits.
The consumer hereby accepts Alma's general terms and conditions of sale.
b. Irrevocability of payment
In accordance with article L 132-2 of the French Monetary Code, electronic payment is irrevocable. PETIT CHELEM therefore recommends that its consumers check the solvency of their payment before validating their order on the site.
In the event of non-payment, Petit Chelem reserves the right to cancel the order.
c. Refund
In the event of a return or activation of the right of withdrawal, we will refund you using the same method of payment that you used for the initial transaction. If an order is paid for with 1 or more vouchers, the refund will be made using the same method of payment.
However, you may contact our customer service department if you wish to arrange a different method. The request will then be checked before any agreement is reached. In any event, this refund will not incur any costs for you.

Anyone who subscribes to the electronic newsletter agrees to receive information emails about PETIT CHELEM offers.
To unsubscribe from the mailing list, the subscriber must send an e-mail to contact@petitchelem.fr or unsubscribe in the ‘my account’ section on the website at petitchelem.fr.
